Vehicle Replacement

The insurance company says your car is totaled — and the settlement offer doesn’t look like enough to replace it. It’s probably not. Initial total-loss offers are negotiable, and they’re routinely thousands below what an equivalent vehicle actually costs. CALLMAA reviews your valuation, helps you challenge a lowball number, and coordinates with your attorney — at no cost to you.

How insurers calculate (and shade) your car’s value

A car is declared totaled when repair costs exceed a percentage of its pre-accident actual cash value (ACV) — the threshold varies by state. The insurer then builds your ACV from “comparable” vehicles — and they choose the comps. The common tricks: cherry-picking the cheapest listings, pulling comps from cheaper markets, ignoring your factory options and recent improvements, and exaggerating wear to justify condition deductions.

Challenging a lowball offer

  • Request the valuation report — you’re entitled to see every comp and adjustment behind the number
  • Gather your evidence — current listings for genuinely comparable vehicles, plus maintenance records, receipts, and pre-accident photos
  • Counter in writing — better comps and documentation, with a specific fair-value figure
  • Escalate if needed — your attorney steps in when the insurer won’t move despite the evidence

Owe more than the car is worth?

That’s negative equity, and it’s exactly what gap insurance exists for — it pays the difference between the ACV settlement and your loan balance. Many people have gap coverage through their financing and don’t know it; we review your policies and loan documents to find out, and make sure it’s applied properly.

The fine print that shrinks your check

Sales tax and certain title/registration fees should be included in your settlement (Missouri mandates some of these) — but dealer fees usually aren’t, rental coverage ends when the settlement finalizes, and the gap between ACV and what replacement actually costs is real. We break the settlement down line by line so you know your true buying power before you sign anything. You can also keep your totaled car for its salvage value — occasionally worth it for rare vehicles or sentimental ones, usually not once the branded title’s hit to safety, insurability, and resale is priced in. We’ll help you run that math too.
